The 2018 Farm Bill defines hemp as cannabis with no more than 0.3% Delta-9 THC by dry weight. Federal hemp rules are changing. A federal law enacted in 2025 replaces the 2018 Farm Bill hemp definition.

The new definition counts total THC, including THCA. It removes finished hemp-derived products from the hemp definition when one container holds more than 0.4 mg of combined total THC.
