Florida Governor Ron DeSantis signed the Florida hemp bill on June 25, 2019, which specifically named CBD containing less than 0.3% THC is legal in the state, beginning July 1. While both CBD and marijuana are derived from the cannabis plant, the differentiating factor is the level of THC, which is the euphoria-inducing component of marijuana. Trace amounts of THC (below 0.3%) are thought to be rapidly absorbed by the body, and therefore non-intoxicating. Hemp products containing more than 0.3% are still considered a Schedule I drug.
The Florida bill passed the state Senate almost unanimously, with additional regulation regarding product safety and packaging. Specifically, CBD oil sold in Florida must be lab-verified to contain no more than 0.3% THC and be free from contaminants and toxins.
Retailers who sell CBD in Florida must have a certificate of analysis from each manufacturer of CBD, to show the product meets the state’s standards.
